Trust Litigation

While trust litigation is not as common as litigation in regard to a deceased person’s estate, trust litigation does occur. As with a typical contest regarding the validity of a deceased person’s last will and testament,¬†allegation are sometime made that a trust/the trust document was fraudulently made, was made when someone was exercising undue influence over the maker of the trust, was made at a time when the trust maker did not have the mental capacity to understand what he/she was doing, etc.

 

Other issues that may arise concern a trustee’s proper administration of the trust, allegations that a trustee has stolen or misused funds of a trust, allegations that a trustee did not property diversify trust assets and allegations that a trustee’s accounting in regard to the trust is not accurate.
